1. About these Terms

These Terms of Service ("Terms") govern your use of the tmra.io website (the "Site"), which is operated by Misraj Information Technology Company, the company that develops and operates the Tmra platform, with its registered address in Al Khobar, Saudi Arabia ("Misraj", "we", "us" or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Scope: marketing site only

The Site is Tmra's marketing and informational website. It describes Tmra's fundraising platform and related products, and lets visitors contact Tmra or request a demonstration. The Site does not process donations, payments, or donor financial information, and it does not host any transactional functionality.

Tmra's fundraising platform itself, where organizations manage campaigns, donations, and donor data, is a separate product operated at app.tmra.io. Use of that platform is governed by its own, separate terms of service and privacy policy, not by these Terms. If you are a donor, organization, or platform user looking for the terms that apply to donations or platform use, please refer to the terms published at app.tmra.io, not this document.

3. The Site is informational, not an offer

Content on the Site, including descriptions of products, features, and any pricing-related language, is provided for general informational purposes only. Nothing on the Site constitutes a binding offer, and no contract for the use of Tmra's platform or any other product is formed by browsing the Site or submitting a contact or demo-request form. A separate agreement, provided by us directly, governs any commercial relationship.

4. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the Site, its underlying systems, or any account not belonging to you
• Interfere with or disrupt the Site's operation, including through automated scraping, denial-of-service activity, or attempts to bypass rate limiting or other technical safeguards
• Submit false, misleading, or fraudulent information through any form on the Site, including the contact and demo-request forms
• Reproduce, resell, or exploit any portion of the Site for commercial purposes without our prior written consent

5. Intellectual property

The Site and its content, including text, graphics, logos, the Tmra name and brand, and the underlying design and code, are owned by us or our licensors and are protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but you may not copy, modify, distribute, or create derivative works from it without our prior written permission, except as permitted by law.

6. Third-party links

The Site contains links to third-party social media platforms (currently X/Twitter, LinkedIn, and Instagram). These are plain outbound links, not embedded content. We do not control, and are not responsible for, the content, availability, or privacy practices of these or any other third-party sites you may reach through the Site. Visiting a linked site is at your own risk and subject to that site's own terms and policies.

7. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including, to the extent permitted by applicable law, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete, accurate, or current.

8. Limitation of liability

To the fullest extent permitted by applicable law, we, and our officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law.

9. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Site or to legal or regulatory requirements. The version published on this page is the current one, and the "last updated" date below indicates when it last changed. Continued use of the Site after an update constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the Kingdom of Saudi Arabia, and any dispute arising from or relating to these Terms is subject to the exclusive jurisdiction of the competent courts of Saudi Arabia.
